Terms of Participation for BrainHive Learning classes and activities.
BehaviorRequired
3.1 Code of Conduct
Children are expected to behave safely and respectfully toward staff, volunteers, and other participants. Parent/Guardian is responsible for their child's conduct.
3.2 Right to Remove
The School may, at its discretion, suspend or remove from a Program any child whose behavior endangers the safety or well-being of themselves or others. Parent/Guardian or an Authorized Pick-Up Person must be reachable during Program Hours and able to pick up the child promptly if required.
IllnessRequired
2.1 Emergency Contact and Medical Information
Parent/Guardian must provide current emergency contact information and disclose any allergies, medical conditions, dietary needs, medications, or other information relevant to their child's safe participation. Parent/Guardian is responsible for keeping this information current.
2.2 Emergency Medical Authorization
In the event of an injury or medical emergency during Program Hours where the Parent/Guardian and emergency contacts cannot be reached, Parent/Guardian authorizes the School to seek and consent to emergency medical care for the child, including transport to a medical facility. Parent/Guardian is responsible for the costs of any such care.
2.3 Illness Policy
Children who are ill or contagious should not be brought to the premises. The School may decline to admit, or may send home, a child who appears ill, and may require pick-up within a reasonable time.
2.4 Medication
The School does not administer medication except by separate written arrangement and authorization. Parent/Guardian must disclose any medication a child carries or requires.

4. Release of Liability
4.1 Assumption of Risk
By registering, you acknowledge that participation involves inherent risks and you voluntarily assume those risks that arise despite the School's reasonable care.
4.2 Release and Hold Harmless
To the fullest extent permitted by law, Student and Parent/Guardian release the School, the Church, and their staff, volunteers, and affiliates from claims arising from the inherent risks of course participation and facility use. This release does not extend to claims arising from gross negligence, recklessness, or willful misconduct, and does not waive any right that cannot be waived under Idaho law, including any claim belonging to the child that a parent is not legally permitted to waive on the child's behalf.
Parent/Guardian agrees to protect and defend the released parties from claims brought by others arising from the Parent/Guardian's or the child's own actions.
4.3 Privacy Release
Personal information is collected and stored through Google, Substack, and Venmo platforms, each governed by their respective privacy policies. Contact information may be used and shared with other School members to fulfill the School's purposes and PDR assistance. By registering, you consent to the collection and use of your and your child's personal information through these third-party services for School operations.
5. Dispute Resolution
5.1 Principles of Peacemaking Primary Dispute Resolution ("PDR")
We as Principled Peacemakers are each responsible to embody three core principles for peacemaking by promising:
Principled Resolution Promise — I promise to authentically, directly, peacefully, and proactively provide feedback and respond to complaints within 30 days. Instead of legal action, I will first seek resolution through direct discussion; second, prepare and share a record detailing my claim, proposed remedy, controlling principles, and undisputed facts with a fellow Principled Peacemaker; third, involve a neutral Principled Peacemaker to help reach an agreeable resolution; and fourth, if required, resolve the dispute by binding arbitration before a mutually acceptable arbitrator.
Integrity Promise — I promise to be honest, fair, and authentic, always keeping my word and taking responsibility for my actions. I will uphold my ethical principles, build trust, and maintain consistency in my relationships and interactions.
Mutual Respect Promise — I promise to respect the autonomy of others, to refrain from seeking remedies in excess of their binding promises and agreements, and to refrain from claiming obligations from others greater than my own obligations to them.
Reputation Acceptance — I accept that dishonoring these promises may stain my reputation until I measure the impact and make amends.
5.2 Scope and Carve-Out
The PDR process applies to disputes between members and the School that the parties may lawfully agree to resolve by these means. It does not apply to, and does not waive, any claim for personal injury to a child or any other claim that cannot, under Idaho law, be subjected to a pre-dispute arbitration or waiver agreement signed by a parent on a child's behalf.
6. General Provisions
6.1 Modification
These Terms may be updated from time to time. Continued participation constitutes acceptance of modified terms.
6.2 Severability
If any provision is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
6.3 Governing Law
These Terms shall be governed by the laws of the State of Idaho.
6.4 Entire Agreement
These Terms constitute the entire agreement between the parties regarding course participation and supersede all prior agreements or understandings.
Photo and media releaseOptional
4.4 Mutual Media Release
Members consent to photos and videos being taken and shared for School purposes, with the restriction that no published work may defame, dehumanize, ridicule, encourage violence or hatred, serve divisive purposes, deceive others, or appeal to prurient interest. Parent/Guardian may opt their child out of media use by written request, and the School will honor such requests.
Drop-off and pick-upRequired
1.1 Supervised Program Hours
During the stated hours of each scheduled course or activity ("Program Hours"), the School provides supervision of enrolled children by its staff and approved volunteers. Parent/Guardian remains responsible for the care, supervision, and well-being of their child(ren) at all times outside of Program Hours, including before drop-off and after pick-up.
The School's responsibility begins only when a child has been signed in by an authorized adult at the designated drop-off location and ends when the child has been signed out. The School does not supervise children during transportation to and from the premises.
1.2 Sign-In and Sign-Out
Each child must be signed in at the start and signed out at the end of every Program. Only the Parent/Guardian or an Authorized Pick-Up Person (Section 1.3) may sign a child out. Staff may require photo identification before releasing a child.
1.3 Authorized Pick-Up Persons
Parent/Guardian must provide, in writing, the names of all adults authorized to pick up their child(ren). The School will not release a child to any adult not on this list without prior written authorization from the Parent/Guardian. The list may be updated at any time in writing.
1.4 Late Pick-Up
Children must be picked up by the stated end of Program Hours. If a child is not picked up on time and no Authorized Pick-Up Person can be reached, the School will follow its late pick-up procedure, which may include contacting emergency contacts and, after reasonable efforts, contacting local authorities for the child's safety. A late pick-up fee may apply.
1.5 Absence and Withdrawal
Parent/Guardian should notify the School in advance of any planned absence. Enrollment, withdrawal, and refund policies are as stated at registration.
